These Terms and Conditions ("Terms") govern your access to and use of the Podiem mobile application ("App") and related services operated by SENTINET CORPORATION LLP ("Podiem", "we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the App.
1. About Podiem
Podiem is an Indian-first social knowledge and creator platform offering three primary experiences:
• PULSE – audience-driven reviews, ratings, and discussions around movies, series, and entertainment.
• CREATORS – professional portfolios for creators, artists, and technicians to showcase work and connect with opportunities.
• PANELS – structured discussions, moderated debates, and expert-led conversations on entertainment, culture, and related topics.
The App is available globally via Google Play and the Apple App Store.
2. Eligibility
Podiem is not intended for children under the age of 13. Users under 18 should use the App under the supervision of a parent or legal guardian. By using the App, you represent that you meet the applicable age requirements in your jurisdiction.
3. Account Registration and Security
To access certain features, you must create an account using:
• Google Sign-In (OAuth)
• Apple Sign-In (OAuth)
• Email or phone number with OTP authentication
You agree to provide accurate and current information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. User-Generated Content
You may submit content such as text, reviews, ratings, comments, photos, videos, audio files, and documents ("User-Generated Content" or "UGC").
You retain ownership of your UGC. However, by posting content on Podiem, you grant us a worldwide, non-exclusive, royalty-free, transferable license to host, store, display, reproduce, distribute, and moderate such content solely for operating and improving the App.
You are solely responsible for your UGC and represent that you have the necessary rights to post it.
5. Content Moderation
Podiem operates as an intermediary under applicable Indian law. We reserve the right to review, moderate, remove, or restrict content that:
• Violates these Terms or applicable laws
• Is offensive, defamatory, hateful, or unlawful
• Infringes intellectual property or privacy rights
Users may report violations through in-app reporting mechanisms.
6. Prohibited Conduct
You agree not to:
• Post illegal, misleading, abusive, or infringing content
• Impersonate others or misrepresent affiliations
• Harvest data or attempt unauthorized access
• Use the App for unsolicited commercial activities
• Reverse engineer, disrupt, or compromise App security
7. Intellectual Property
All content and materials in the App (excluding UGC), including trademarks, logos, designs, and software, are owned by Podiem or its licensors and are protected by applicable laws.
You may not copy, modify, distribute, or create derivative works without prior written consent.
8. Third-Party Services
The App integrates third-party services including:
• Google and Apple authentication services
• TMDB API for public movie and television metadata
Podiem is not responsible for third-party services or their privacy practices.
9. Beta Features
Certain features, including PULSE, may be offered in beta form. Beta features are provided "as is" without warranties and may be modified, suspended, or discontinued at any time.
10. Account Termination
You may delete your account at any time via the App settings or by submitting a request at https://podiemapp.com/account-deletion.
We may suspend or terminate access to the App at our discretion for violations of these Terms or legal requirements.
11. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, Podiem shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or reputation.
Our total liability shall not exceed INR 1,000 or the amount paid by you to Podiem, if any.
13. Indemnification
You agree to indemnify and hold harmless Podiem from claims arising out of your use of the App, your UGC, or violation of these Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts located in Hyderabad, Telangana shall have exclusive jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the App constitutes acceptance of updated Terms.
